These Terms & Conditions (“Terms”) govern your access to and use of challengemania.net, including any mobile applications, video players, APIs, and related services (collectively, the “Platform” or “Service”).

The Platform is owned and operated by Challenge Mania (“we,” “us,” or “our”).

By visiting, registering, purchasing PPV access, streaming, uploading content, or otherwise using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Platform.

1. Key Definitions

• “User” / “you”: anyone who accesses or uses the Platform.
• “Content”: all audio-visual, text, images, livestreams, recordings, metadata, and materials on the Platform.
• “Licensed Content”: content owned by or licensed to Challenge Mania from third parties.
• “User-Generated Content (UGC)”: content uploaded/posted by Users.
• “Pay-Per-View (PPV) Access”: a one-time paid right to view particular Content for a specified window or number of plays.
• “Intermediary”: our role regarding UGC under India’s IT Act, 2000.

2. Eligibility

2.1 You must be 18+ to create an account or purchase PPV access.

2.2 Users aged 13–17 may use the Platform only under a verified parent/guardian account and supervision.

2.3 You represent that you are legally competent to contract under Indian law and will provide accurate information.

3. Accounts & Security

3.1 You may need to register to purchase PPV access, comment, or upload UGC.

3.2 You are responsible for:

• keeping login credentials confidential;
• all activity under your account;
• all UGC uploaded via your account.

3.3 We can suspend/terminate accounts if we detect fraud, abuse, policy violations, or legal non-compliance.

4. Pay-Per-View Pricing, Billing & Access Windows

Important: Challenge Mania is PPV-based, not subscription-based.

4.1 Pricing & What You Get
Each PPV title will show, before purchase:

• price,
• viewing window (e.g., 24/48/72 hours) OR number of views,
• device/territory limitations,
• any bonus inclusions.

These disclosures align with India’s Consumer Protection Act and E-Commerce Rules requiring clear, pre-purchase information.

4.2 Payment Authorization
By buying PPV access, you authorize us (or our payment partners) to charge your payment method for that one-time transaction.

4.3 Taxes
GST or other taxes will be displayed at checkout and are payable by you.

4.4 Access Start & Expiry
Your PPV access begins:

• immediately upon successful payment (unless stated otherwise), and
• expires after the displayed time window/plays.

We are not responsible for expiry caused by your delayed viewing.

4.5 Refund Policy
Unless required by law:

• PPV purchases are non-refundable once playback starts,
• if a title is technically unplayable due to our fault, we may refund or re-credit at our discretion,
• no refunds for user-side issues (device, internet, accidental purchase), except where mandated under Indian consumer law.

5. License to Stream

We grant you a limited, non-exclusive, non-transferable, revocable license to stream Content:

• only for personal, non-commercial use,
• only within the PPV access window,
• only by permitted devices/users.

6. Acceptable Use

You agree you will not:

• record, download (unless we explicitly allow), rip, redistribute, or rebroadcast streams;
• bypass DRM, geo-locks, paywalls, or security;
• use bots, scrapers, or automated systems;
• reverse engineer or disrupt the Platform;
• resell PPV access or share accounts commercially;
• use the Platform for unlawful, harmful, or abusive purposes.

Violation can lead to removal of content, suspension, or legal action.

7. User-Generated Content (UGC) & Intermediary Status

Because you can upload content, Challenge Mania acts as an “intermediary” for UGC. Safe-harbour protection under Section 79 of the IT Act, 2000 applies only if we follow due diligence obligations, including notice-and-action and grievance redressal.

7.1 Your Rights & License to Us

You keep ownership of your UGC.
By uploading/posting, you grant Challenge Mania a worldwide, royalty-free, sublicensable license to host, store, stream, reproduce, adapt (for encoding/formatting), distribute, and promote your UGC only to operate and market the Platform.

7.2 UGC Rules

You must not upload UGC that:

• violates any law or court order;
• infringes copyright/trademark/privacy/publicity;
• is defamatory, obscene, pornographic involving minors, hateful, violent, harassing, or misleading;
• promotes terrorism or other unlawful activity.

We may remove or restrict such content and report it if legally required.

7.3 Moderation

We may (but are not obligated to) review, flag, age-gate, demonetize, restrict, or remove UGC.

8. Copyright & Takedown (Notice-and-Action)

We respect IP rights and follow India’s intermediary takedown requirements.

If you believe content infringes your rights, email our Grievance Officer (Section 17) with:

1. your name and contact details;
2. identification of the copyrighted work;
3. exact URL(s) of infringing content;
4. proof of ownership/authorization;
5. good-faith statement;
6. electronic signature.

We may remove/disable content and terminate repeat infringers.

9. Licensed Content

9.1 Licensed Content is protected under the Copyright Act, 1957 and belongs to licensors/Challenge Mania.

9.2 Licensed Content may be removed or restricted due to licensing, legal, or policy reasons. We don’t guarantee perpetual availability.

10. Streaming Quality & Availability

• Video quality depends on your device and internet speed.
• Playback may be interrupted by network conditions, maintenance, or force majeure.
• We may change features, content libraries, or platform tech without liability.

11. Privacy & Data Protection (DPDP Act)

We process personal data per our Privacy Policy and India’s Digital Personal Data Protection Act, 2023 (and rules/notifications in force).

You have rights to:

• access and correction,
• erasure (where applicable),
• withdraw consent,
• grievance redressal.

If children’s data is processed, it will be handled with verifiable parental consent and safeguards as required.

12. Suspension & Termination

12.1 By You: stop using the Platform anytime. PPV access already purchased will still expire per its window.

12.2 By Us: we may suspend or terminate accounts/access if you:

• violate these Terms or Indian law;
• infringe IP repeatedly;
• commit fraud or chargebacks;
• threaten platform integrity or user safety.

13. Disclaimers

The Platform is provided “as is” and “as available.”
We disclaim warranties of merchantability, fitness, and non-infringement to the extent permitted by law.

We do not guarantee uninterrupted, error-free, or fully secure Service.

14. Limitation of Liability

To the maximum extent allowed by law:

• we are not liable for indirect, incidental, special, or consequential damages;
• our total liability will not exceed the PPV amount paid by you for the specific title giving rise to the claim, or INR 5,000 (whichever is lower).

Nothing here limits liability that cannot be excluded under Indian law.

15. Indemnity

You agree to indemnify and hold Challenge Mania harmless from claims arising out of:

• your UGC;
• your misuse of the Platform;
• your breach of these Terms;
• infringement of third-party rights.

16. Governing Law & Jurisdiction

These Terms are governed by Indian law.
Courts in Delhi NCR, India shall have exclusive jurisdiction, subject to mandatory consumer rights.

17. Grievance Officer (India-Specific)

As required under the IT Intermediary Rules, 2021, we appoint a Grievance Officer.

18. Miscellaneous

• Severability: if any part is invalid, the rest remains enforceable.
• No Waiver: delay in enforcement isn’t waiver of rights.
• Assignment: you may not assign your rights; we may assign ours with business transfer.
• Force Majeure: no liability for events beyond reasonable control.
